Darkstar Automotive Detailing — General Service Terms & Conditions
1. Acceptance of Terms
By booking or engaging Darkstar Automotive Detailing ("Darkstar", "we", "us" or "our") for any service, the customer ("you" or "the customer") acknowledges that they have read, understood and agreed to these Terms & Conditions.
2. Vehicle Access & Customer Responsibility
The customer is responsible for ensuring that the vehicle is legally parked, safely accessible and available at the agreed appointment time. The customer must provide Darkstar with reasonable access to the vehicle and any necessary keys, access codes or other information required to complete the service.
3. Removal of Personal Belongings
Customers are required to remove all personal belongings, valuables, documents, money, electronic devices and other items from the vehicle prior to the commencement of the service.
Darkstar will not intentionally handle, move, remove or clean around personal belongings left inside the vehicle.
If personal belongings remain in a particular area of the vehicle, Darkstar will not move those belongings in order to clean the area, and that area may therefore be left uncleaned or only partially serviced.
Where practical, Darkstar may notify the customer of belongings preventing access to an area before commencing work.
Darkstar is not responsible for the loss, damage or movement of personal belongings that remain inside the vehicle, except where liability cannot lawfully be excluded under applicable law.
4. Valuables & Sensitive Items
Customers should never leave cash, jewellery, watches, wallets, identification documents, electronics or other valuable or sensitive items inside the vehicle during a detailing service.
Darkstar reserves the right to refuse to handle any item that appears valuable, fragile, sensitive or otherwise inappropriate for our staff to move.
5. Pre-Detail Vehicle Inspection & Pre-Existing Damage
A pre-detail inspection will be conducted before work commences on every vehicle where reasonably practicable. This inspection is intended to identify and document the vehicle's condition prior to detailing and to minimise confusion or disputes regarding pre-existing damage or defects.
The inspection may include photographs, videos and/or written notes documenting areas such as:

scratches and scuffs
-
dents
-
paint chips
-
paint defects
-
stains
-
marks and discolouration
-
damaged or deteriorated trim
-
cracked or damaged plastics
-
damaged leather or upholstery
-
loose components
-
damaged badges, emblems or decals
-
existing water spots or paint contamination
-
aftermarket modifications or accessories
Where reasonably identifiable, Darkstar may photograph areas of concern before commencing the service.
The customer may be asked to acknowledge the condition of the vehicle before work begins. The purpose of this inspection is to establish a record of the vehicle's pre-service condition and prevent confusion regarding whether damage or defects existed before Darkstar commenced work.
The customer acknowledges that vehicles may contain pre-existing damage or deterioration that becomes more noticeable once dirt, contamination or other material has been removed.
Darkstar will not be responsible for pre-existing damage, deterioration or defects that were present before the service commenced, subject to the customer's rights under applicable Australian law.
6. Fragile, Loose or Deteriorated Components
Due to age, wear, previous repairs, environmental exposure or deterioration, vehicle components may be fragile or unsecured.
This may include:

trim and mouldings
-
badges and emblems
-
decals
-
paint protection film
-
window tint
-
leather and upholstery
-
stitching
-
plastics
-
rubber seals
-
headliners
-
buttons and controls
-
aftermarket modifications
Darkstar will take reasonable care when working around such components. However, where a component is already damaged, deteriorated, loose or improperly installed, cleaning may expose or aggravate an existing condition.
7. Aftermarket Modifications
The customer is responsible for informing Darkstar of any aftermarket modifications, accessories, coatings, wraps, paint protection film, window tint, decals or other non-factory additions that may require special care.
Darkstar should be informed of any known limitations or manufacturer-specific requirements before work begins.
8. Cleaning Limitations
Darkstar will make reasonable efforts to achieve the best possible result within the scope of the service purchased. However, no detailing service guarantees the complete removal of every stain, mark, odour, scratch, contamination or defect.
Certain conditions may be permanent or may require specialist services outside the scope of Darkstar's standard detailing services, including:

permanent staining

deep scratches
-
paint damage
-
etched contamination
-
severe odours
-
mould
-
cigarette burns
-
pet damage
-
heavily embedded dirt
-
oxidation
-
water spotting
-
permanent discolouration
Darkstar will not be responsible for defects that cannot reasonably be removed through the service purchased.
9. Additional Work
If the condition of a vehicle requires substantially more work than reasonably expected for the selected service, Darkstar may recommend an additional service or additional charge.
Darkstar will obtain the customer's approval before undertaking additional chargeable work wherever reasonably practicable.
10. Water & Electrical Components
Darkstar takes reasonable precautions when using water, cleaning products and equipment.
Customers must disclose any known electrical, mechanical, sealing or other vehicle issues that could be relevant to the detailing process before work begins.
Darkstar will exercise reasonable care around electrical components and sensitive areas but cannot guarantee the condition or watertight integrity of components that are already damaged, improperly sealed or defective.
11. Payment
A deposit may be required to secure an appointment. The remaining balance is payable upon completion of the service unless otherwise agreed.
Any outstanding balance remains payable regardless of whether the customer subsequently raises a concern regarding the service, subject to the customer's rights under applicable Australian law.
12. Cancellations & Late Cancellations
The deposit paid at the time of booking is non-refundable in the event that the customer cancels their appointment, except where a refund is required by applicable law or otherwise agreed by Darkstar at its discretion.
Cancellations made on the day the service is scheduled to be provided will also incur a late cancellation fee. The applicable late cancellation fee will be communicated to the customer at the time of booking or prior to the appointment.
Where applicable, the non-refundable deposit and late cancellation fee are intended to compensate Darkstar for the appointment time that has been reserved and the resulting loss of availability for other customers.
13. Late Arrival / Vehicle Unavailability
If the customer is not present or the vehicle is not reasonably accessible at the scheduled appointment time, Darkstar may be required to shorten, reschedule or cancel the service.
Where a delay materially affects Darkstar's schedule, the appointment may be treated as a missed appointment and the applicable cancellation policy may apply.
14. Customer Inspection Following Completion
Customers are encouraged to inspect their vehicle promptly following completion of the service and to raise any concerns with Darkstar as soon as reasonably possible.
Where a concern relates to the quality or scope of the service provided, Darkstar will be given a reasonable opportunity to inspect the vehicle and, where appropriate, rectify the issue.
15. Damage Claims & Disputes
Any allegation that Darkstar has caused damage to a vehicle should be reported as soon as reasonably practicable, preferably before the vehicle is driven or subsequently serviced, modified or cleaned by another party.
Darkstar may request photographs, videos, vehicle history, pre-detail inspection records, pre-service photographs or other relevant information when investigating a claim.
Where a pre-detail inspection has been conducted, the inspection record may be used when determining whether the alleged damage was present before the service commenced.
16. Limitation of Liability
To the maximum extent permitted by law, Darkstar's liability arising from the provision of its services will be limited to the remedies available under applicable Australian law.
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot legally be excluded, restricted or modified under the Australian Consumer Law or other applicable legislation.
17. Third-Party Services & Products
Where a customer specifically requests the use of a particular product, treatment or third-party service, Darkstar will take reasonable care in its application but cannot guarantee the performance, longevity or suitability of products where the outcome depends on factors outside Darkstar's reasonable control.
18. Images & Documentation
Darkstar may take photographs and/or videos of vehicles for the purposes of:

documenting pre-existing condition
-
conducting the pre-detail inspection
-
documenting completed work
-
quality control
-
investigating potential disputes or damage claims
Darkstar will not publicly use identifiable photographs of a customer's vehicle for marketing purposes where appropriate permission is required and has not been provided.
19. Right to Refuse or Modify a Service
Darkstar reserves the right to refuse, modify or discontinue a service where the vehicle presents an unreasonable safety risk, contains hazardous materials, has conditions that may result in damage during cleaning, or where completing the requested service would be outside Darkstar's reasonable capabilities.
20. General
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply to the maximum extent permitted by law.
These Terms & Conditions are governed by the laws applicable in Queensland, Australia.
22. Customer Agreement
By proceeding with a booking, the customer acknowledges that they have had the opportunity to review these Terms & Conditions and agree to them, subject to their rights under applicable Australian law.
Darkstar Automotive Detailing — Platinum Membership terms & conditions
Darkstar Platinum is a recurring vehicle maintenance program designed to make keeping your vehicle in exceptional condition simple, consistent and effortless.
By joining Darkstar Platinum, you agree to the following terms and conditions.
1. Membership & Pricing
Darkstar Platinum is a recurring subscription charged at $199 per month, per vehicle.
Each Platinum subscription applies to one registered vehicle only. The subscription cannot be transferred between vehicles, shared between vehicles, or used to service multiple vehicles under a single subscription.
A single customer may hold up to five (5) active Darkstar Platinum subscriptions, provided that each subscription is assigned to a separate vehicle.
Each vehicle must have its own active Platinum subscription to receive the included monthly maintenance detail.
2. The Signature — Initial Requirement
Before a vehicle can enter the regular Darkstar Platinum maintenance cycle, it must first be brought to the required Darkstar standard.
The Signature is compulsory for all new Platinum vehicles and is offered at 75% off the standard price as part of joining Darkstar Platinum.
This initial service is necessary because the Platinum maintenance detail is designed to maintain a vehicle's established condition rather than restore a vehicle that has been neglected, heavily soiled or allowed to deteriorate.
The Signature allows Darkstar to properly prepare the vehicle so that subsequent monthly maintenance details can be performed efficiently and consistently.
The Signature requirement applies when:

A vehicle joins Darkstar Platinum for the first time; or
-
Darkstar determines that a vehicle has fallen sufficiently below the required maintenance standard that it must undergo a higher-level detail before regular maintenance can continue.
3. One Maintenance Detail Per Billing Period
Each active Platinum subscription includes one (1) maintenance detail per billing period.
The included maintenance detail must be booked and completed within the applicable billing period.
Unused maintenance details do not roll over, accumulate, transfer or convert into credit.
For example, if a member does not use their included maintenance detail during March, they cannot use two maintenance details during April.
This policy exists because Darkstar Platinum is a maintenance program, not a bank of detailing credits. Regular servicing at appropriate intervals is essential to maintaining the vehicle at the Darkstar standard.
4. Booking Your Monthly Maintenance Detail
Members are responsible for booking their included maintenance detail within each billing period.
Darkstar may provide reminders and booking links to assist members in scheduling their monthly service; however, failure to receive, read or act upon a reminder does not extend the applicable billing period or create an entitlement to a missed service.
Members are encouraged to book their next appointment as early as possible to secure their preferred date and time.
Appointments are subject to Darkstar's available scheduling capacity.
5. Vehicle Condition & Additional Work
Darkstar Platinum is designed for vehicles that are maintained consistently.
The standard maintenance detail assumes that the vehicle is in a condition reasonably consistent with regular monthly maintenance.
If, at the time of an appointment, a vehicle is found to be in substantially worse condition than reasonably expected for a maintained vehicle, Darkstar reserves the right to:

Apply an additional charge for the additional time, labour or products required;

Reduce the scope of the maintenance detail to the standard included work;
-
Recommend and quote an additional detailing service;
-
Require the vehicle to undergo The Signature or another higher-level detail before regular Platinum maintenance can continue; or
-
Cancel and reschedule the appointment where the vehicle's condition makes it impractical to complete the maintenance detail within the allocated appointment time.
Where reasonably possible, Darkstar will discuss any additional charges with the customer before additional chargeable work is undertaken.
Examples of conditions that may result in additional charges include, but are not limited to:

Excessive mud, dirt or contamination;
-
Significant staining;
-
Excessive pet hair;
-
Sand or debris beyond normal levels;
-
Food, drink or other spills;
-
Excessive rubbish or personal belongings;
-
Biohazardous or hazardous contamination;
-
Heavy insect contamination;
-
Excessive tar, sap, iron contamination or other bonded contaminants;
-
Vehicles that have not been maintained for an extended period; or
-
Any condition requiring substantially more time than the standard maintenance detail allocation.
6. Personal Belongings & Vehicle Access
Customers are responsible for removing valuable, fragile or personal belongings from their vehicle before the appointment.
Darkstar is not responsible for personal belongings left inside the vehicle.
The customer must ensure that the vehicle is accessible at the scheduled appointment time and that Darkstar has sufficient access to carry out the service.
7. Cancellation & Rescheduling
Customers must provide as much notice as reasonably possible when cancelling or rescheduling an appointment.
Repeated late cancellations, no-shows or failure to provide reasonable access to the vehicle may result in additional charges, loss of the applicable maintenance detail or termination of the Platinum membership at Darkstar's discretion.
A cancellation does not automatically extend the customer's billing period.
Where an appointment cannot be completed due to the condition of the vehicle, access issues or circumstances outside Darkstar's reasonable control, Darkstar may reschedule the service to an appropriate date.
8. Membership Suspension & Cancellation
Customers may cancel their Platinum subscription in accordance with the cancellation terms presented at the time of purchase.
Once the subscription is cancelled, no further monthly maintenance details will be available after the end of the applicable paid membership period.
Any unused maintenance detail entitlement expires with the applicable billing period and is not redeemable for cash, credit or alternative services.
The Signature is a separate initial service offered at a 75% discounted rate as part of joining Platinum. The discounted amount is non-refundable once The Signature has been commenced or completed.
Darkstar reserves the right to suspend or terminate a membership where a customer repeatedly breaches these terms, fails to make required payments, engages in abusive or inappropriate conduct, or otherwise compromises Darkstar's ability to provide the service safely and professionally.
9. Changes to the Vehicle
A Platinum subscription is assigned to the specific vehicle registered at the time of purchase.
If the customer sells, replaces or permanently changes their vehicle, they must contact Darkstar before attempting to use the subscription for another vehicle.
Darkstar may, at its discretion, allow a subscription to be transferred to a replacement vehicle subject to the new vehicle meeting the requirements of the Platinum program and completing any required initial service.
10. Service Standards
Darkstar Platinum provides ongoing maintenance designed to preserve the presentation and condition of a vehicle.
While Darkstar will always perform the maintenance detail to a professional standard, the results achievable during each appointment are dependent on the vehicle's condition, age, materials, previous care, environmental exposure and the nature of any existing defects or contamination.
The Platinum membership does not guarantee the removal of permanent stains, scratches, paint defects, etching, oxidation, damage, wear or other conditions that require corrective detailing, paint correction, restoration or specialist treatment.
Additional services may be recommended where necessary.
11. Weather & Circumstances Beyond Darkstar's Control
As a mobile detailing service, Darkstar may occasionally need to postpone or reschedule an appointment due to severe weather, unsafe working conditions, access restrictions, power/water limitations or other circumstances outside its reasonable control.
Where this occurs, Darkstar will make reasonable efforts to reschedule the service at the earliest suitable opportunity.
12. Weather & Complimentary Exterior Touch-Up Guarantee
As a mobile detailing business, Darkstar may need to reschedule services where weather or environmental conditions make it unsafe or impractical to perform the service to an appropriate standard.
Where reasonably possible, Darkstar will provide reasonable notice and arrange an alternative appointment.
Complimentary Exterior Touch-Up Guarantee:
If rain occurs within 24 hours of a completed detailing service, Darkstar will provide the customer with a complimentary exterior touch-up upon request.
The touch-up is intended to restore the exterior appearance affected by rainfall and will be limited to a reasonable exterior maintenance touch-up. It does not constitute a complete re-detailing service and does not cover damage, contamination or conditions caused by factors other than ordinary rainfall.
The complimentary touch-up must be requested within a reasonable period following the rainfall and is subject to reasonable scheduling availability.
This guarantee does not apply where the vehicle has subsequently been washed, detailed, modified, contaminated or otherwise materially altered by the customer or a third party following the original service.
13. Membership Capacity
Darkstar reserves the right to limit the number of active Platinum memberships available at any given time to ensure that sufficient appointment capacity is available to maintain the service standard promised to members.
If Platinum memberships are temporarily unavailable for purchase, existing members will not be affected provided their subscription remains active and in good standing.
14. Agreement
By purchasing or maintaining a Darkstar Platinum subscription, the customer acknowledges that they have read, understood and agreed to these terms.
